§ Three. Conditions of occupancy.

  • (A)

    The system shall be constructed, operated and maintained by the franchisee so as to cause minimum interference with the proper use of streets, alleys, easements, and other public ways and places, and to cause minimum interference with the rights and reasonable convenience of property owners who adjoin any of the said streets, alleys, easements or other public ways or places. The franchisee shall at all times comply with the terms of the city's Right-of-Way management ordinance. Said Right-of-Way Management ordinance shall take precedence in the event of conflict.

    (B)

    The franchisee shall have the authority, after notifying the city of its intent to do so, to trim trees on streets so as to prevent said trees from coming into contact with the franchisee's system, and to make other reasonable right-of-way improvements with the approval of the city.

    (C)

    In all sections of the city where communications cable facilities are placed underground, the franchisee shall place its system underground to the extent that existing technology reasonably permits the franchisee to do so.
