§ 4-30. Review upon denial of application.

  • If an application for a license under this article is denied by the city council, the applicant may request, in writing, a review of such denial by the city council. Such request shall be made by the applicant within ten (10) days after the application for license has been denied by the city council. Upon the written request for review made within the time specified, the city council shall, within thirty (30) days after the receipt of such request, reinvestigate and reexamine the circumstances surrounding such application and the denial thereof. The city council may set aside the denial of such application if a majority of its members determine that such application should be granted, and the city council may order the issuance of the license applied for. In the event that the city council does not approve or disapprove the application within thirty (30) days from the date such application is filed, then it shall be assumed that such application is denied.
