§ 25-136. Inspection, sampling, and analysis.

  • (a)

    Authorized personnel, bearing proper credentials and identification, shall be permitted to enter, without delay, all properties for the purposes of inspection, observation, measurement, sampling, and testing pertinent to the discharge to the POTW in accordance with the provisions of this article.

    (b)

    While performing the necessary work on private properties referred to in [subsection] (a) of this section, the authorized personnel shall observe all safety rules applicable to the premises established by the user, and the user shall be held harmless for injury or death to the authorized personnel, and the user shall be indemnified against loss or damage to its property by the authorized personnel and against liability claims and demands for personal injury, or property damage asserted against the user and growing out of the gauging and sampling operation, except as such may be caused by negligence or failure of the user to maintain safe conditions as required in section 25-135(b).

    (c)

    Sampling and analyses to determine compliance with a pretreatment standard shall be performed in accordance with procedures established by the administrator pursuant to section 304(g) of the act and contained in 40 CFR, Part 136 and amendments thereto. Where 40 CFR, Part 136, does not include a sampling or analytical technique or sampling frequency for the pollutant in question, sampling and analysis shall be performed in accordance with the procedures set forth in the EPA publication "Sampling and Analysis Procedures for Screening of Industrial Effluents for Priority Pollutants," April, 1977, and amendments thereto, or with any other sampling or analytical procedures approved by the administrator.

    (d)

    Analysis to determine characteristics of wastes other than those addressed by this section shall be in accordance with the latest edition of "Standard Methods for the Examination of Water and Wastewater," published by the American Public Health Association et. al., or other procedures approved by the public works director. Sampling methods, locations, times, durations, and frequencies are to be determined on an individual basis subject to approval by the city manager.
