§ 25-104. Civil penalties.

  • (a)

    Any user who is found to have violated an order of the city council or who willfully or negligently failed to comply with any provision of this article, and the orders, rules, regulations and permits issued hereunder, shall be fined not less than one hundred dollars ($100.00) nor more than one thousand dollars ($1,000.00) for each offense. Each day on which a violation shall occur or continue shall be deemed a separate and distinct offense. In addition to the penalties provided herein, the city may recover reasonable attorneys' fees, court costs, court reporters' fees and other expenses of litigation by appropriate suit at law against the person found to have violated this article or the orders, rules, regulations, and permits issued hereunder.

    (b)

    In addition to penalties for violations or failures to comply described in [subsection] (a) of this section, the sewer may be dug out where it connects with the city line, plugged and tamped back at the expense of the user. The sewer may be unplugged when the user complies with this article. A fee established by this article shall be charged for each time the sewer is dug.
