§ 22-7. Plat expiration.

  • (a)

    In the event that final plat has been approved by the city and development, including required infrastructure, is not completed within seven (7) years from the city council's approval, the developer must resubmit the original plat to the planning and zoning commission for approval. The city council, after report and recommendation from the city planning and zoning commission, may repeal or require revisions. Action of repeal or revision of a plat shall require a public hearing initiated by the city and will require an enacting ordinance.

    In the event a subdivision is built in phases, the phase that is final platted shall be completed in the same seven (7) year time frame.

    (b)

    Final platted nondeveloped subdivisions that exist prior to the date of the passage of this chapter shall be developed within seven (7) years from their final plat approval. If seven (7) years has expired since the plat approval, the city shall notify the owner/developer of the subdivided land of their intent to review the plat. If within ninety (90) days of said notice, there has not been satisfactory arrangements between the city and owner regarding the development of the preexisting platted subdivision, the city shall hold a public hearing to repeal the plat.
