§ 13-32. Definitions.

  • For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:

    Add-ons. Factory-built room enclosure erected, constructed or attached to a manufactured home for residential use by the occupants of a manufactured home.

    Board. Means the board of adjustment.

    Certificate of occupancy. A certificate indicating completion of the work to include those requirements contained within this chapter necessary for human occupancy. Such a certificate shall be required to place a manufactured home within a park.

    City. City of Kirksville, Missouri.

    Code official. Any representative of the city's code department and/or fire department inspection division.

    Common areas. The open spaces on the premises and/or adjoining property under the control of owners or operators of such premises, and visible without entering the interior of a manufactured home.

    Cross connection. Any physical connection or arrangement between two (2) otherwise separate piping systems, one of which contains potable water and the other either water of unknown or questionable safety or steam, gas or chemical, whereby there exists the possibility for flow from one (1) system to the other, with the direction of flow depending on the pressure differential between the two (2) systems.

    Detached accessory building. An incidental freestanding building located on the same lot which it serves and is used solely for storage of personal equipment and possessions of the manufactured home occupants.

    Garbage. The animal and vegetable waste resulting from the handling, preparation, cooking and consumption of food.

    Manufactured home. A residential building unit constructed and/or assembled in a factory that is certified under the HUD (Housing and Urban Development) Code.

    Manufactured home lot. A parcel of land within a manufactured home park used for the placement of a single manufactured home and the exclusive use of its occupants.

    Manufactured home park. Any area, lot, parcel or tract held in common ownership, and on which individual portions of said area, lot, parcel or tract are leased for the placement of manufactured homes as a primary residence.

    Mobile home. A residential home constructed and/or assembled in a factory which is not certified pursuant to the HUD Code or the building code adopted by the city, and which conforms to the American National Standard Institute (ANSI) standards for Mobile Homes.

    Modular home: A residential building constructed and/or assembled in a factory and conforming to the Missouri standards set forth in 4 CSR 24-123.080 of the Missouri Code of State Regulations, and the city's CABO One and Two-family Dwelling Code.

    Park owner: The person or party, that is the owner of record of the lands contained within the boundaries of the manufactured home park. For enforcement purposes of this ordinance "Park Owner" may be the assignee or manager so designated by the owner of record of the manufactured home park.

    Placement permit. A written permit issued by the city, permitting the placement of a manufactured home upon a manufactured home lot under the provisions of this article, and regulations issued hereunder.

    Rubbish and trash. Combustible and noncombustible refuse and waste materials, except garbage; the term shall include the residue from the burning of wood, coal, coke, and other combustible materials, paper, rags, cartons, boxes, wood, excelsior, leather, rubber, tree branches, yard trimmings, tin cans, metals, mineral matter, glass, crockery, furniture, appliances and dust and other similar materials.

    Sewer connection. The connection consisting of all pipes, fittings, etc., from the drain outlet of the manufactured home to the inlet of the corresponding sewer riser pipe.

    Sewer riser pipe. That portion of the sewer lateral which extends vertically to the ground elevation and terminates at a designated point at each manufactured home lot.

    Streets. A thoroughfare, either private or public, reserved for vehicles and providing access to adjoining properties and lots.

    Tie down system. A method of anchoring and securing a manufactured home as stipulated by the manufacturer and/or the Missouri Public Service Commission.

    Unfit for human occupancy. A manufactured mobile home is unfit for human occupancy whenever the code official finds that it is unsafe, unlawful, or because of the degree to which it is in disrepair or lacks maintenance, is unsanitary, vermin or rat-infested, contains filth and contamination, or lacks ventilation, illumination, sanitary or heating facilities or other essential equipment required by this chapter, and thereby constitutes a hazard to the occupants or to the public.

    Utilities. Water and sewer, gas or electrical distribution system which are available for connection to manufactured homes in a manufactured home park.
