§ 2. [Right to use streets, alleys, etc.]

  • The grantee herein is expressly given the nonexclusive right and permit to use the streets, avenues, roads, highways, alleys, sidewalks, and other public rights-of-way, as now laid out, or may hereafter be established, for the purpose of laying gas mains, pipelines, conduits and feeders, and the necessary attachments, fixtures, connections, buildings, structures, and appurtenances for the purpose of conveying or conducting gas from any point within the said city, or to any point beyond the city limits of the said city, or to any other point, through and beyond the city limits of said city, and to operate and maintain a system of pipelines, pipes, conduits, feeders, and the necessary attachments, connections, buildings, structures, fixtures, and appurtenances for the distribution of gas within said city to serve the said city and the residents or inhabitants thereof, and others; provided, however, that where alleys and rear lot utility easements are accessible for laying mains and pipes, the city shall have the right to require that the mains and pipes shall be laid in the alleys and/or rear lot utility easements instead of the streets so long as such a requirement is economically feasible (i.e., such requirement does not create an economic hardship on the grantee). Plans for laying mains in city rights-of-way must be submitted to the city engineer for approval prior to installation.
